It’s one thing to know and exercise your rights when a police officer pulls you over, but what rights do you have when a private cop—entrusted with all of the powers of a government cop but not held to the same legal standards—pulls you over and subjects you to a stop-and-frisk or, worse, causes you to “disappear” into a Gitmo-esque detention center not unlike the one employed by Chicago police at Homan Square?

For that matter, how do you even begin to know who you’re dealing with, given that these private cops often wear police uniforms, carry police-grade weapons, and perform many of the same duties as public cops, including carrying out SWAT team raids, issuing tickets and firing their weapons.

This is the growing dilemma we now face as private police officers outnumber public officers (more than two to one), and the corporate elite transforms the face of policing in America into a privatized affair that operates beyond the reach of the Fourth Amendment.

Mind you, it’s not as if we had many rights to speak of, anyhow.

A Government of Wolves book coverOwing to the general complacency of the courts and legislatures, the Fourth Amendment has already been so watered down, battered and bruised as to provide little practical protection against police abuses. Indeed, as I make clear in my book A Government of Wolves: The Emerging American Police State, we’re already operating in a police state in which police have carte blanche authority to probe, poke, pinch, taser, search, seize, strip and generally manhandle anyone they see fit in almost any circumstance. Expanding on these police powers, the U.S. Supreme Court recently gave law enforcement officials tacit approval to collect DNA from any person, at any time.

However, whatever scant protection the weakened Fourth Amendment provides us dissipates in the face of privatized police, who are paid by corporations working in partnership with the government. Talk about a diabolical end run around the Constitution.

We’ve been so busy worrying about militarized police, police who shoot citizens first and ask questions later, police who shoot unarmed people, etc., that we failed to take notice of the corporate army that was being assembled under our very noses. Looks like we’ve been outfoxed, outmaneuvered and we’re about to be out of luck.

Indeed, if militarized police have become the government’s standing army, privatized police are its private army—guns for hire, if you will. This phenomenon can be seen from California to New York, and in almost every state in between. According to the Bureau of Labor Statistics, the private security industry is undergoing a boom right now, with most of the growth coming about due to private police doing the jobs once held by public police. For instance, Foley, Minnesota, population 2600, replaced its police force with private guards

Technically, a private police force is one that is owned or controlled by a non-governmental body such as a corporation. Those who advocate for privatized services and limited government hail the shift towards private police as a step in the right direction by getting the government out of the business of policing and allow market principles to dictate an officer’s success, i.e., if an officer abuses his authority, he can easily be fired.

Read the fine print, however, and you’ll find that these private police aka guns-for-hire a.k.a. private armies a.k.a. company police officers a.k.a. secret police a.k.a. conservators of the police a.k.a. rent-a-cops don’t exactly remove the government from the equation. Instead, they merely allow them to work behind the scenes, conveniently insulated from any accusations of wrongdoing or demands for transparency. Indeed, most private police officers are either working for private security firms that are contracted by the government or are government workers moonlighting on their time off.

What began as a job detail for wealthy communities and businesses looking to discourage burglaries has snowballed into a lucrative enterprise for private corporations. Today these private police can be found wherever extra security is “needed”: at hospitals, universities, banks, shopping malls, gated communities, you name it.

As historian Heather Ann Thompson notes, “private security firms have come substantially to supplement, if not completely to replace, the publicly-funded public safety presence of troubled inner cities ranging from Oakland, to New Orleans, to small towns in states such Minnesota, to entire neighborhoods—sometimes extremely rich, sometimes desperately poor—in urban centers such as Atlanta and Baltimore.”

For example, in New Orleans, a 50-person private police squad funded by a “voluntary” hotel tax is being charged with enforcing traffic, zoning and other non-emergency laws in the French Quarter.

In Seattle, off-duty Seattle Police officers moonlighting as a private security force patrol wealthy neighborhoods “approximately six nights/days a week for five hours each shift. Officers are in uniform, carry police radios and their police firearms and drive unmarked personal vehicles.”

In California, private mercenaries—many of them ex-U.S. Special Forces, Army Rangers and other combat veterans—equipped with AR-15 rifles use unmarked helicopters to police cannabis farms and cut down private gardens without a warrant.

Yet while these private police firms enjoy the trappings of government agencies—the weaponry, the arrest and shoot authority, even the ability to ticket and frisk— they’re often poorly trained, inadequately screened, poorly regulated and heavily armed. Now if that sounds a lot like public police officers, you wouldn’t be far wrong.

First off, the label of “private” is dubious at best. Mind you, this is a far cry from a privatization of police. These are guns for hire, answerable to corporations who are already in bed with the government. They are extensions of the government without even the pretense of public accountability. One security consultant likened the relationship between public and private police to public healthcare: “It’s basically, the government provides a certain base level. If you want more than that, you pay for it yourself.”

The University of Chicago’s police department (UCPD) is a prime example of how private security firms are being entrusted with the legal status of private police forces (which sets them beyond the reach of the rule of law) and the powers of public ones. With a jurisdiction that covers a six-square-mile area and is home to 65,000 individuals, the majority of whom are not students, UCPD is one of the largest private security forces in America.

The private police agency, modeled after the tactics of NYPD chief William Bratton, criminalizes nonviolent activities such as loitering, vandalism, smoking marijuana, and ​dancing “reck​l​essly” and punishes minor infractions severely in order to “discourage” violent crime. To this end, the UCPD can search, ticket, arrest, and detain anyone they choose without being required to disclose to the public its reasons for doing so. Not surprisingly, the UCPD has been accused of using racial profiling to target individuals for stop-and-frisks.

Second, these private contractors are operating beyond the reach of the law. For example, although private police in Ohio are “authorized by the state to carry handguns, use deadly force and detain, search and arrest people,” they are permitted to keep their arrest and incident reports under wraps. Moreover, the public is not permitted to “check the officers’ background or conduct records, including their use-of-force and discipline histories.” As attorney Fred Gittes remarked, “There is no accountability. They have the greatest power that society can invest in people — the power to use deadly force and make arrests. Yet, the public and public entities have no practical access to information about their behavior, eluding the ability to hold anyone accountable.”

So what happens when the government hires out its dirty deeds to contractors who aren’t quite so discriminating about abiding by constitutional safeguards, especially as they relate to searches and heavy-handed tactics? If you think police abuses are worrisome, security expert Bruce Schneier warns that “abuses of power, brutality, and illegal behavior are much more common among private security guards than real police.”

As Schneier points out, “Many of the laws that protect us from police abuse do not apply to the private sector. Constitutional safeguards that regulate police conduct, interrogation and evidence collection do not apply to private individuals. Information that is illegal for the government to collect about you can be collected by commercial data brokers, then purchased by the police. We’ve all seen policemen ‘reading people their rights’ on television cop shows. If you’re detained by a private security guard, you don’t have nearly as many rights.”

Third, more often than not, the same individuals are serving in both capacities, first on the government payroll, then moonlighting for the corporations. Not surprisingly, given the demand for private police, you’ll find that police in most cities work privately while they are off-duty. Some private officers started off as public officers, then made the switch once they saw how lucrative the field could be.

This gives rise to another interesting phenomenon, a schism, if you will, between what is permissible in the private sector versus and what is allowed in the public sector, and how it affects those who travel between both worlds. We saw this played out in St. Louis, Missouri, when an off-duty police officer, working a secondary shift for a private security firm, shot and killed a teenager.

Fourth, what few realize is that these private police agencies are actually given their police powers by state courts and legislatures, which do not require them to act in accordance with the Constitution’s strictures or be accountable to “we the people.” As legal analyst Timothy Geigner observes, “They’re hiding from public scrutiny behind the veil of incorporation, which may rank right up there among the most cynical things a government organization has ever done. It’s a move one might find in the corporate republic of some dystopian novel. I say that because it’s truly not as though the police departments in question are attempting to claim some kind of exemption within public records law. They’re just putting up a stone wall.”

It’s not as if we have much in the way of local, publicly accountable police forces now; they all answer to the militarized agencies that provide their equipment and training. These private cops simply swell the government’s ranks and serve as the private arm of the law.

In fact, the Department of Justice has been one of the most vocal advocates for the benefits that private security—which has twice the budget and manpower as their government counterparts—can provide in partnership with public police. These so-called “benefits” are outlined in the DOJ’s guidebook entitled “Operation Partnership: Practices and Trends in Law Enforcement and Private Security Collaborations,” which focuses on how both sectors can share cutting-edge technology, information, and personnel resources. Sounds cozy, doesn’t it?

As history shows, we’re not forging a new path with these private police agencies, either. In fact, we’re simply following a model established long ago, not only by Hitler and Mussolini, who relied on private guards to do their bidding, but also by the likes of Andrew Carnegie and John D. Rockefeller, who relied on their own private police force, the Pinkertons, who had broad authority to “harass or hurt anyone their employers deemed a threat—be they a worker trying to get a fair wage or a poor person begging near the doorstep of a mansion.”

Nevertheless as historian Heather Ann Thompson points out, “despite countless historical accounts of why private policing of public spaces is a bad idea in a democracy, ordinary Americans have raised little ruckus today when, once again, only those Americans with money are assured access to security and protection.” Thompson continues:

Worse, astonishing faith has been expressed in the much-touted proposition that private police forces, in fact, act in the best interests of the public. Where is the concern, if not the outrage, that there is virtually no regulation when it comes to private policing in America’s inner cities? Not only can individuals with little if any training police public spaces, but in various locales they are even authorized to make arrests and wield firearms. What is more, unlike public police, private security officers are not required by law to read a suspect his or her Miranda Rights and, more incredibly, they are allowed to use force, in some circumstances even deadly force, if they deem it necessary to do so.

What we’re finding ourselves faced with is a government of mercenaries, bought and paid for with our tax dollars, all the while claiming to be beyond the reach of the Constitution’s dictates.

When all is said and done, privatization in the American police state amounts to little more than the corporate elite providing cover for government wrong-doing.

Either way, the American citizen loses.

President Obama has managed, with singular assistance from Congress and the courts, to mangle the Constitution through repeated abuses, attacks and evasions.

This is nothing new, as I’ve documented in my book A Government of Wolves: The Emerging American Police State. However, with his recent speech on the National Security Agency—a heady cocktail of lies, obfuscations, contradictions and Orwellian doublespeak—Obama has also managed to pervert and propagandize our nation’s history, starting with Paul Revere and the Sons of Liberty, likening their efforts to secure our freedoms to NSA phone surveillance. Frankly, George Orwell’s Winston Smith, rewriting news stories for Big Brother and the Ministry of Truth, couldn’t have done a better job of revising history to suit the party line.

While it didn’t bode well for what was to follow, here’s how Obama opened his speech:

At the dawn of our Republic, a small, secret surveillance committee borne out of the ‘The Sons of Liberty’ was established in Boston. And the group’s members included Paul Revere. At night, they would patrol the streets, reporting back any signs that the British were preparing raids against America’s early Patriots. Throughout American history, intelligence has helped secure our country and our freedoms.

Obama’s inference is clear: rather than condemning the NSA for encroaching on our privacy rights, we should be commending them for helping to “secure our country and our freedoms.” Never mind that the Sons of Liberty were actually working against the British government, to undermine what they perceived as a repressive regime guilty of perpetrating a host of abuses against the colonists.

After such a 1984-esque send-up, it doesn’t even really matter what else Obama had to say in his speech about NSA reforms and the like. Rest assured, it was largely a pack of lies. Mind you, Obama said it eloquently enough and interspersed it with all the appropriately glib patriotic remarks about individual freedom and the need to defend the Constitution and securing the life of our nation while preserving our liberties. After all, Obama has proven to be very good at saying one thing and doing another, whether it’s insisting that “you can keep your health care plan,” that he’ll close Guantanamo, or that his administration’s controversial drone strikes only target terrorists and not civilians.

When it comes to the NSA, Obama has been lying to the American people for quite some time now. There was the time he claimed the secret FISA court is “transparent.” Then he insisted that “we don’t have a domestic spying program.” And then, to top it all off, he actually insisted there was no evidence the NSA was “actually abusing” its power. As David Sirota writes for Salon: “it has now become almost silly to insinuate or assume that the president hasn’t also been lying. Why? Because if that’s true — if indeed he hasn’t been deliberately lying — then it means he has been dangerously, irresponsibly and negligently ignorant of not only the government he runs, but also of the news breaking around him.”

Sirota continues:

I, of course, don’t buy that at all. I don’t buy that a constitutional lawyer and legal scholar didn’t know that the FISA court is secret — aka the opposite of “transparent.” I don’t buy that he simply didn’t see any of the news showing that spying is happening in the United States. And I don’t buy that he didn’t know that there is evidence — both public and inside his own administration — of the NSA “actually abusing” its power.

I don’t buy any of that because, to say the least, it makes no sense. I just don’t buy that he’s so unaware of the world around him that he made such statements from a position of pure ignorance. On top of that, he has a motive. Yes, Obama has an obvious political interest in trying to hide as much of his administration’s potentially illegal behavior as possible, which means he has an incentive to calculatedly lie. For all of these reasons, it seems safe to suggest that when it comes to the NSA situation, the president seems to be lying.

So in terms of Obama’s latest speech on the NSA, if you read between the lines—or just ignore the president’s words and pay attention to his actions—it’s clear that nothing is going to change. The NSA will continue to abuse its power by spying on Americans’ phone calls and emails. They will continue to collect metadata on our various communications and activities. And they will continue to carry out their surveillance in secret, with no attempts at transparency or accountability.

The NSA will do so, no matter what Obama claims to the contrary, because this black ops-funded agency whose very existence is abhorrent to the Constitution has become a power unto itself. They no longer work for us or for the president, for that matter. He works for them.

Remember, Obama is the chief executive of a super secretive surveillance state whose overarching purpose is to remain in power by any means available. As such, he and his surveillance state cohorts have far more in common with King George and the British government of his day than with the American colonists who worked hard to foment a rebellion and overthrow a despotic regime.

Indeed, Obama and his speechwriters would do well to brush up on their history. In doing so, they will find that the Sons of Liberty, the “small, secret surveillance committee” they conveniently liken to the NSA, was in fact an underground, revolutionary movement that fought the established government of its day, whose members were considered agitators, traitors and terrorists not unlike Edward Snowden.

In much the same way that the U.S. government under the leadership of Barack Obama is today going after whistleblowers and activists who oppose their tactics, the British government went after the Sons of Liberty. These people were neither career politicians nor government bureaucrats. Instead, they were mechanics, merchants, artisans and the like—ordinary people groaning under the weight of Britain’s oppressive rule—who, having reached a breaking point, had decided that enough was enough. Through the use of Committees of Correspondence, they alerted the colonists to the abuses being meted out by the British crown by way of pamphlets, speeches and resolutions, inciting them to actively resist the acts of oppression, and conspiring with them to revolt.

The colonists’ treatment at the hands of the British was not much different from the abuses meted out to the American people today: they too were taxed on everything from food to labor without any real say in the matter, in addition to which they had their homes invaded, their property seized and searched, their families terrorized, their communications, associations and activities monitored, and their attempts to defend themselves and challenge the government’s abuses dismissed as belligerence, treachery, and sedition.

Unlike most Americans today, who remain ignorant of the government’s abuses, cheerfully distracted by the entertainment spectacles trotted out before them by a complicit media, readily persuaded that the government has their best interests at heart, and easily cowed by the slightest show of force, the colonists responded to the government’s abuses with outrage, activism and rebellion. They staged boycotts of British goods and organized public protests, mass meetings, parades, bonfires and other demonstrations, culminating with their most famous act of resistance, the Boston Tea Party.

On the night of December 16, 1773, a group of men dressed as Indians boarded three ships that were carrying tea. Cheered on by a crowd along the shore, they threw 342 chests of tea overboard in protest of a tax on the tea. Many American merchants were aghast at the wanton destruction of property. A town meeting in Bristol, Massachusetts, condemned the action. Ben Franklin even called on his native city to pay for the tea and apologize. But as historian Pauline Maier notes, the Boston Tea Party was a last resort for a group of people who had stated their peaceful demands but were rebuffed by the British: “The tea resistance constituted a model of justified forceful resistance upon traditional criteria.”

The rest, as they say, is history. Yet it’s a history we cannot afford to forget or allow to be rewritten. The colonists suffered under the weight of countless tyrannies before they finally were emboldened to stand their ground. They attempted to reason with the British crown, to plea their cause, even to negotiate. It was only when these means proved futile that they resorted to outright resistance, civil disobedience and eventually rebellion.

More than 200 years later, we are once again suffering under a long train of abuses and usurpations. What Americans today must decide is how committed they are to the cause of freedom and how far they’re willing to go to restore what has been lost. Nat Hentoff, one of my dearest friends and a formidable champion of the Constitution, has long advocated for the resurgence of Committees of Correspondence. As Nat noted:

This resistance to arrant tyranny first became part of our heritage when Samuel Adams and the Sons of Liberty formed the original Committees of Correspondence, a unifying source of news of British tyranny throughout the colonies that became a precipitating cause of the American Revolution. Where are the Sons of Liberty, the Committees of Correspondence and the insistently courageous city councils now, when they are crucially needed to bring back the Bill of Rights that protect every American against government tyranny worse than King George III’s? Where are the citizens demanding that these doorways to liberty be opened … What are we waiting for?

What are we waiting for, indeed? As Thomas Jefferson said, “I prefer dangerous freedom over peaceful slavery.”

The recent revelation that the National Security Agency (NSA) is collecting the telephone records of millions of Verizon customers, with the complete blessing of the Obama administration, should come as no surprise to anyone who has been paying attention over the past decade.

As I document in my new book A Government of Wolves: The Emerging American Police State (available now at Amazon.com), what we are witnessing, in the so-called name of security and efficiency, is the creation of a new class system comprised of the watched (average Americans such as you and me) and the watchers (government bureaucrats, technicians and private corporations). What too many fail to realize, consumed as they are with partisan politics and blinded by their own political loyalties, is that the massive bureaucracies—now computerized—that administer governmental policy transcend which party occupies the White House.

This explains why the civil liberties abuses carried out by the Bush Administration have not been corrected by the Obama Administration. Rather, they have been expanded upon. Take, for instance, the warrantless wiretapping program conducted during the Bush years, which resulted in the NSA monitoring the private communications of millions of Americans—a program that continues unabated today, with help from private telecommunications companies such as AT&T. The program recorded 320 million phone calls a day when it first started. It is estimated that the NSA has intercepted 15 to 20 trillion communications of American citizens since 9/11.

To our misfortune, the Obama White House has proven to be even worse than the Bush White House when it comes to invading the privacy rights of Americans. As Yale law professor Jack Balkin notes, “We are witnessing the bipartisan normalization and legitimization of a national-surveillance state. [Obama has] systematically adopted policies consistent with the second term of the Bush Administration.” Unfortunately, whereas those on the Left raised a hew and cry over the Bush administration’s constant encroachments on Americans’ privacy rights, it appears that the political leanings of those on the Left have held greater sway than their principles. Consequently, the Obama administration has faced much less criticism for its blatant efforts to reinforce the surveillance state.

Insisting that terrorists “will come after us if they can and the only thing that we have to deter this is good intelligence to understand that a plot has been hatched and to get there before they get to us,” Senator Dianne Feinstein (D-Calif.), who chairs the Senate intelligence committee, is defending the NSA’s actions, as well as the secret court order requiring Verizon to turn over its phone records to government agents. It’s a tired, overused line that preys on Americans’ fear of another terrorist attack and offers phantom promises of security while ensuring neither safety nor greater freedom. Even the vague and unsupported claim put forth by House Intelligence Committee Chairman Mike Rogers (R-Mich.) that the NSA surveillance program “helped thwart ‘a significant case’ of terrorism in the United States ‘within the last few years’” fails to justify a program of this magnitude, which makes everyone a target and turns us all into a nation of suspects.

Clearly, the age of privacy in America is coming to a close. We have moved into a new paradigm in which surveillance technology which renders everyone a suspect is driving the bureaucratic ship that once was our democratic republic. It will not be long before no phone call, no email, no Tweet, no web search is safe from the prying eyes and ears of the government. People going about their daily business will no longer be assured that they are not being spied upon by federal agents and other government bureaucrats.

Thus, the question looms before us.  Can freedom in the United States continue to flourish and grow in an age when the physical movements, individual purchases, conversations, and meetings of every citizen are constantly under surveillance by private companies and government agencies?

Whether or not the surveillance is undertaken for so-called “worthy” (read: politically expedient) reasons such as preventing another terrorist attack, does not surveillance of all citizens gradually poison the soul of a nation and render us all data collected in government files? Does not such surveillance completely eviscerate our right to be free from unreasonable searches and seizures as guaranteed by our Constitution?

Immediately following the devastating 9/11 attacks, which destroyed the illusion of invulnerability which had defined American society since the end of the Cold War, many Americans willingly ceded their rights and liberties to government officials who promised them that the feeling of absolute safety could be restored.

In the 12 years since, we have been subjected to a series of deceptions, subterfuges and scare tactics by the government, all largely aimed at amassing more power for the federal agencies and extending their control over the populace. Starting with the wars in Afghanistan and Iraq, continuing with the torture of detainees at Abu Ghraib and Guantanamo Bay, and coming to a head with the assassination of American citizens abroad, the importing of drones and other weapons of compliance, and the rise in domestic surveillance, we have witnessed the onslaught of a full-blown crisis in government.

Still Americans have gone along with these assaults on their freedoms unquestioningly.

Even with our freedoms in shambles, our country in debt, our so-called “justice” system weighted in favor of corporations and the police state, our government officials dancing to the tune of corporate oligarchs, and a growing intolerance on the part of the government for anyone who challenges the status quo, Americans have yet to say “enough is enough.”

Now, in the wake of the Boston Marathon bombing, we are once again being assured that if we only give up a few more liberties and what little remains of our privacy, we will achieve that elusive sense of security we’ve yet to attain. This is the same song and dance that comes after every tragedy, and it’s that same song and dance which has left us buying into the illusion that we are a free, safe society.

The reality of life in America tells a different tale, however. For example, in a May 2013 interview with CNN, former FBI counterterrorism agent Tim Clemente disclosed that the federal government is keeping track of all digital communications that occur within the United States, whether or not those communicating are American citizens, and whether or not they have a warrant to do so.

As revelatory as the disclosure was, it caused barely a ripple of dismay among Americans, easily distracted by the torrent of what passes for entertainment news today. Yet it confirms what has become increasingly apparent in the years after 9/11: the federal government is literally tracking any and all communications occurring within the United States, without concern for the legal limitations of such activity, and without informing the American people that they are doing so.

Clemente dropped his bombshell during a CNN interview about authorities’ attempts to determine the nature of communications between deceased Boston bombing suspect Tamerlan Tsarnaev and his widow Katherine Russell. In the course of that conversation, Clemente revealed that federal officials will not only be able to access any voicemails that may have been left by either party, but that the entirety of the phone conversations they had will be at federal agents’ finger tips.

“We certainly have ways in national security investigations to find out exactly what was said in that conversation,” stated Clemente. “All of that stuff [meaning phone conversations occurring in America] is being captured as we speak whether we know it or like it or not.” A few days later, Clemente was asked to clarify his comments, at which point he said, “There is a way to look at all digital communications in the past. No digital communication is secure.”

In other words, there is no form of digital communication that the government cannot and does not monitor—phone calls, emails, text messages, tweets, Facebook posts, internet video chats, etc., are all accessible, trackable and downloadable by federal agents.

At one time, such actions by the government would not only have been viewed as unacceptable, they would also have been considered illegal. However, government officials have been engaged in an ongoing attempt to legitimize these actions by passing laws that make the lives of all Americans an open book for government agents. For example, while the nation was caught up in the drama of the Boston bombing and the ensuing military-style occupation of the city by local and federal police, Congress passed a little-noticed piece of legislation known as the Cyber Intelligence Sharing and Protection Act (CISPA). The legislation, which the House of Representatives approved by an overwhelming margin of 288-127, will allow internet companies to share their users’ private data with the federal government and other private companies in order to combat so-called “cyber threats.”

In short, the law dismantles any notion of privacy on the internet, opening every action one undertakes online, whether emailing, shopping, banking, or just browsing, to scrutiny by government agents. While CISPA has yet to clear the U.S. Senate Committee on Commerce, Science, and Transportation, the spirit of it is alive and well. In fact, officials in the Obama administration have for some time now been authorizing corporate information sharing and spying in secret through the use of executive orders and other tactics.

The Justice Department, for instance, has been issuing so-called “2511 letters” to various internet service providers like AT&T, which immunize them from being prosecuted under federal wiretapping laws for providing the federal government with private information. Despite federal court rulings to the contrary, the Department of Justice continues to assert that it does not require a warrant to access Americans’ emails, Facebook chats, and other forms of digital communication.

While it may be tempting to lay the full blame for these erosions of our privacy on the Obama administration, they are simply continuing a system of mass surveillance, the seeds of which were planted in the weeks after 9/11, when the National Security Agency (NSA) began illegally tracking the communications of American citizens. According to a Washington Post article published in 2010, the NSA continues to collect 1.7 billion communications, whether telephone, email or otherwise, every single day.

The NSA and Department of Justice are just two pieces of a vast surveillance network which encompasses and implicates most of the federal government, as well as the majority of technology and telecommunications companies in the United States. For the past two years, the United States Foreign Intelligence Surveillance Court has approved literally every single request by the federal government to spy on people within the United States. There have been some 4,000 applications rubberstamped by the court in the past two years, applications which allow federal officials to monitor the communications of any person in the United States, including American citizens, if they are believed to be in contact with someone overseas.

These government-initiated spying programs depend in large part on the willingness of corporations to hand over personal information about their customers to government officials. Sometimes the government purchases the information outright. At other times, the government issues National Security Letters, which allow the government to force companies to hand over personal information without a warrant or probable cause.

Some web companies, such as Skype, have already altered their products to allow government access to personal information. In fact, government agents can now determine the credit card information and addresses of Skype users under suspicion of criminal activity. Aside from allowing government agents backdoor access to American communications, corporations are also working on technologies to allow government agents even easier access to Americans’ communications.

For example, Google has filed a patent for a “Policy Violation Checker,” software which would monitor an individual’s communications as they type them out, whether in an email, an Excel spreadsheet or some other digital document, then alert the individual, and potentially their employer or a government agent, if they type any “problematic phrases” which “present policy violations, have legal implications, or are otherwise troublesome to a company, business, or individual.” The software would work by comparing the text being typed to a pre-defined database of “problematic phrases,” which would presumably be defined on a company-by-company basis.

The emergence of this technology fits in well with Google chairman Eric Schmidt’s view on privacy, which is that “If you have something that you don’t want anyone to know, maybe you shouldn’t be doing it in the first place.” Unfortunately, this is not just the attitude of corporate benefactors who stand to profit from creating spy technology and software but government officials as well.

Additionally, police officials throughout the country have become increasingly keen on monitoring social media websites in real time. Rob D’Ovido, a criminal justice professor at Drexel University, has noted that, “The danger of this in light of the tragedy in Boston is that law enforcement is being so risk-averse they are in danger of crossing that line and going after what courts would ultimately deem as free speech.”

For example, Cameron Dambrosio, a teenager and self-styled rap artist living in Metheun, Massachusetts, posted a video of one of his original songs on the internet which included references to the White House and the Boston bombing. While the song’s lyrics may well have been crude and ill-advised in the wake of the Boston bombing, police officers exacerbated the situation by arresting Dambrosio and charging him with communicating terrorist threats, a felony charge which could land him in prison for twenty years.

Unfortunately, cases like Dambrosio’s may soon become the norm, as the FBI’s Next Generation Cyber Initiative has announced that its “top legislative priority” this year is to get social media giants like Facebook and Google to comply with requests for access to real-time updates of social media websites. The proposed method of encouraging compliance is legal inquiries and hefty fines leveled at these companies. The Obama administration is expected to support the proposal.

The reality is this:  we no longer live in a free society. Having traded our freedoms for a phantom promise of security, we now find ourselves imprisoned in a virtual cage of cameras, wiretaps and watchful government eyes. All the while, the world around us is no safer than when we started on this journey more than a decade ago. Indeed, it well may be that we are living in a far more dangerous world, not so much because the terrorist threat is any greater but because the government itself has become the greater threat to our freedoms. — John W.
